Notes

1. Een Nederlandse ‘notaris’ heeft een belangrijkere positie dan de (AmE) notary public (= BrE  commissioner for oaths). Iedere Amerikaanse burger kan zich voor deze functie aanmelden via het betreffende Departement van de Staat waarin hij/zij woont (legitimatie is vereist en er wordt een kleine administratieve vergoeding gevraagd, de aanstelling is steeds voor beperkte duur, bijv. 4 jaar); een staat als Virginia heeft maar liefst 120.000 personen die als notary public zijn aangesteld (d.d. 15 nov. 2006; zie de website van de Office of the Secretary of the Commonwealth: link). Voor de hele Verenigde Staten wordt het aantal geschat op 4,5 miljoen (in 2013, (link).

In de Amerikaanse staat Louisiana, en de Canadese provincies Quebec en British Columbia bestaat het notarisambt waarvoor een volwaardige rechtenstudie vereist is wel, en ze kunnen worden aangeduid met termen als “notaries-at-law” of “lawyer notaries”. Hetzelfde geldt voor Puerto Rico. Desondanks worden ze net als hun collega’s in andere staten of provincies ook als ‘notary public’ aangeduid. Deze ‘lawyer notaries’ kunnen voor het leven worden aangesteld, terwijl in de meeste staten een ‘notary public’ hooguit een korte cursus volgt, en voor een kortere periode wordt aangesteld. De functie van een gewone Amerikaanse ‘notary public’ beperkt zich tot die van een ‘commissioner of oaths’, hoewel de precieze omvang van hun bevoegdheden per staat is geregeld. Een ‘notary public’ in Florida heeft bijvoorbeeld een iets uitgebreider takenpakket dan die in vele andere staten. Zie wikipedia (link).

N.B. in de VS is een advocaat ook vaak een notary public, en in Canada wordt men meteen als notary public beëdigd wanneer men tot de advocatuur toetreedt (Canadians called to the bar are simultaneously sworn in as notaries public.)

Op officiële Canadese justitiële websites wordt voor het certificeren van documenten (= certification / notarization) wel verwezen naar een “commissioner of oaths”, “notary public”, of “Justice of the Peace”. Daarbij wordt opgemerkt dat die functie buiten Canada ook door vergelijkbare personen mag worden vervuld, zoals “a judge”, “a magistrate”, a “notary public”, “an officer of a court of justice”, of “a commissioner authorized to administer oaths in the country in which he is living”.  Zie bijv. de officiële immigratiewebsite (link), of de site van het Canadese Ministerie van Justitie (link).

Vertaaltips en dilemma’s:
De wisselende en onduidelijke kwalificaties die voor de functie van(AmE) “notary public’ vereist zijn, en de uiteenlopende bevoegdheden en status die dit met zich meebrengt, kan makkelijk tot verwarring leiden. Soms wordt deze verwarring bewust uitgebuit. Een Amerikaanse “notary public” die zich bijvoorbeeld onder de Spaanstalige bevolkingsgroepen in het zuiden van de VS profileert met de titel “notario publico”, wekt daarmee soms bewust de verkeerde indruk dat hij/zij een rechtenstudie heeft voltooid. In Mexico is de functie van ‘notario publico’ namelijk voorbehouden aan juristen. In het volgende tekstfragment komt een personage voor die in de VS als koppelbaas werkt en tevens als “notary public” mag fungeren. Op zijn visitekaartje heeft hij deze functie echter ten onrechte met de Spaanse titel “notario publico” vertaald:
“He holds (…) out [a business card] at arm’s length. ‘”Miguelito Espinoza.’Mexican labor contractor.’ He hands me the card and I make a note (…) On the other side of the card, everything under the name is printed in Spanish, including a title ‘notario publico’. in this case it means the man holds a license as a notary public. He can verify documents and put his seal on them. The designation is often used north of the border to give a false implication to those not speaking English that the holder is a lawyer, as the title would signify in Mexico. ” (Steve Martini, The Arraignment, chapter 2).
In de Nederlandse vertaling wordt de Spaanse term onvertaald verlaten (hetgeen terecht is), maar om een Nederlandse lezer niet op het verkeerde been te zetten en ten onrechte de indruk te wekken dat (AmE) notary public een “soort notaris” is (een titel die in Nederland betekent dat iemand een juridische opleiding heeft genoten en dus jurist is) had in dit geval de Amerikaanse term ‘notary public’ ook beter onvertaald kunnen worden gelaten.
– “Hij houdt het [visitekaartje]  een eind van zich af. (…) “‘Miguelito Espinoza.’ Een Mexicaanse koppelbaas.” Hij geeft me het kaartje (…). Aan de andere kant van het kaartje is alles onder de naam in het Spaans, inclusief de titel ‘notario publico’. In dit geval betekent het dat de man een soort notarisvergunning heeft. Hij is bevoegd om documenten te verifiëren en er een zegel op te zetten. Die titel wordt in de Verenigde Staten vaak gebruikt om bij mensen die geen Engels spreken ten onrechte de indruk te wekken dat de persoon in kwestie jurist is.” (De Afspraak, vertaald door Hugo Kuiper, hfdst 2)

De meeste notarissen (notaries) in Engeland en Wales zijn tevens solicitor (en hebben dus een volledige rechtenstudie gevolgd). Hiermee komen hem/haar ook meer bevoegdheden toe dan hetgene een commissioner of oaths toekomt, namelijk het certificeren van handtekeningen, getuigenverklaringen (affidavits, depositions) etc. Daarnaast kan een notaris wel een volledige beroepsopleiding volgen, onder auspiciën van de Universiteit van Cambridge en de Society of Notaries of England and Wales (link). Deze circa 1000 specialistische “notaries public” hebben veelal een goede vreemde-talenkennis, en werken vaak in een internationale context, c.q. bij het opstellen van documenten (testamenten, aktes, etc.) die voor internationaal gebruik zijn bedoeld (link)..

Ook in Ierland is een notary doorgaans tevens solicitor, die onder auspiciën van de Faculty of Notaries Public een speciaal notarisexamen heeft afgelegd. In Schotland is een notary altijd ook solicitor (link).

In Australië en Nieuw-Zeeland wordt de taak van het rechtsgeldig verklaren (certificeren) van documenten veelal door een Justice of the Peace (JP) , of een Commissioner for Affidavits, vervult. Ook voor deze functie is, net als voor de Amerikaanse/Canadese notary public, geen beroepsopleiding vereist. Echter hun bevoegdheid is beperkt tot het certificeren van documenten voor binnenlands gebruik (en enkele Commonwealth-landen). Voor buitenlands gebruik wordt daarom een verklaring van een Australische notary public gevraagd (dus van een notaris met een volwaardige rechtenopleiding), en er kan daarbovenop dus nog een legalisatiestempel of apostillestempel vereist zijn. Het aantal juristen dat de functie van full-time ‘notary public ‘ kiest is relatief laag. Zie wikipedia link.

De meeste Australische notarissen zijn volwaardige juristen en worden voor het leven aangesteld. In de Australische staat Victoria  dient een Diploma of Notarial Practice te worden behaald. In de Amerikaanse staat Louisiana, in Zuid-Afrika, en in andere landen volgen notarisssen een volwaardige rechtenstudie, vaak met een specialisitische graad in het notariaal recht, net als in Nederland. De rol van de Amerikaanse public notary komt dus meer overeen met die van de Australische Justice of the Peace dan met de Australische notary.

From Helen Gubby’s English Legal Terminology, 2nd edition, 2007 (p. 28):

…. it should be pointed out that the term ‘notary’ does not denote a separate strand of the legal profession in the USA or England. A ‘notary public’ has authority to witness and draw up certain documents, and so make them official. In England this is usually done by a solicitor [refer to note 15 below]. In the USA, this can be done by an attorney but it can also be done by a private individual who has applied to act as a notary […]. Those Dutch law firms that are aware of this tend to use the expression ‘civil law notaries’. This has the advantantage of making their common law colleagues take note that some sort of unfamiliar function is involved here, but the term is not one that will be self-evident to them …

Vertaaltips en dilemma’s:
Omdat er in Engelstalige landen als de VS en Canada geen exacte tegenhanger van de Nederlandse ‘notaris’ is, kiest de Nederlandse beroepsgroep zelf het liefst voor de vertaling civil-law notary (of men laat het woord onvertaald en voegt een korte toelichting toe).
Nederlandse vertalers vertalen ‘notary public’ bijna altijd met ‘notaris’. De volgende vertaalvoorbeelden laten echter zien dat een één-op-één vertaling van het Amerikaanse “notary (public)” met (Ned.) ‘notaris’ soms raar kan overkomen. Ook het werkwoord “notarize” in de betekenis van ‘notarieel waarmerken/bekrachtigen’  is voor Nederlanders niet altijd duidelijk. En dat geldt in het verlengde daarvan ook voor de AmE term “affidavit”. Een ‘notaris’ in de Nederlandse betekenis komt er namelijk zelden aan te pas.

2. (AmE) notarization van een document betekent dat het document als ‘kopie conform’ wordt gewaarmerkt door een notary public (een beëdigd overheidsfunctionaris); dit is min of meer gelijk aan het ondertekenen en stempelen door een daartoe, namens de overheid, bevoegd, dan wel door de rechtbank beëdigd persoon; voor internationaal gebruik, moet een document soms (ook) worden ‘gelegaliseerd’ ter controle van de echtheid van een document/handtekening; dit wordt in de VS authentication, legalization of certification genoemd, en geldt bijvoorbeeld voor schooldiploma’s, geboorteaktes, huwelijksaktes, immigratiepapieren, vital record (een uittreksel van de burgerlijke stand, zie link: link), certificate of good standing (een soort uittreksel van de Kamer van Koophandel voor bedrijven, dat in de VS per staat wordt afgegeven door een Authentication Office van de betreffende staat (zie bijv. de info. van de staat Virginia: link), etc.; voor landen die bij het Apostilleverdrag zijn aangesloten is een Certification of Apostille (Apostille-document) nodig.

3. Politierangen kunnen soms het best onvertaald worden gelaten, omdat er niet altijd een (exact) Nederlands equivalent is. Bovendien is er een uniform landelijk rangenstelsel bij de Britse politie (behalve m.b.t. de hoogste rangen bij de London Metropolitan Police). De corpsen in de meeste Engelstalige Commonwealth-landen zoals Canada, Australië en Nieuw-Zeeland, volgen het Britse systeem. In de VS zijn er veel verschillende rangen, ook tussen de korpsen onderling. Zie de tabel hieronder:

vertaaltips en dilemma’s
De vertaalsuggestie in het woordenboek van Van Dale: “(ongeveer:) vrederechter” lijkt niet bruikbaar voor (AmE) constable. Voor zover de functie in bepaalde gevallen een justitieel aspect heeft, is het  eerder vergelijkbaar met de taken van een ‘deurwaarder’ (het betekenen van rechterlijke uitspraken, dwangbevelen).
(AmE) constable is ook zeker geen “hoofd van de politie” (zie de vertaling van The Last Juror van John Grisham)

4. Minister van Justitie
(BrE) Minister of Justice: pas sinds 2007, toen het Ministry of Justice een apart ministerie werd, gevormd uit een onderdepartement van het Ministerie van Binnenlandse Zaken (dit onder deel van the Home Office heette tot 2007 the Department for Constitutional Affairs).

5. felony / misdemeanor
(BrE) felony = misdaad en misdrijf
(AmE) felony = misdaad
De termen felony (misdrijven zoals diefstal, overval, drughandel, etc. waar een gevangenisstraf op staat, op te leggen door een Crown Court, eventueel met jury) en misdemeanor (‘overtredingen’ die doorgaans met een boete worden bestraft zonder tussenkomst van een rechtbank) zijn geen officiële Britse termen meer. In het Amerikaanse rechtsysteem worden ze nog wel gehanteerd.
Volgens Garner’s Dictionary of Legal Usage (3e ed., 2011):
“Before the distinction between felonies and misdemeanors was abolished by the Criminal Law Act 1967, English lawyers used misdemeanour, as they spelled it, to refer to any criminal affense that was neither a felony nor treason. In BrE, the word is primarily of historical interest. But most American jurisdictions retain the felony – misdemeanor distinction.”
“In most American states today, a felony is any crime punishable by death or imprisonment for a year or more, while a misdemeanor is any crime with a lesser punishment.”

6. (BrE) Committal proceedings kunnen bestaan uit een vooronderzoek door een magistrate’s court aan de hand van schriftelijke vragen (= preliminary enquiry) of mondeling (= preliminary investigation).

7. huwelijk / geregistreerd partnerschap / samenwonen
(AmE/AusE/CanE) civil union ; (BrE) civil partnership = geregistreerd partnershap

Aantekening:
“Both terms mean a marriage-like relationship that may be registered with and recognized by civil authorities as meriting some or all of the legal benefits of marriage.”

9. mayor / burgomaster
In tegenstelling tot een Amerikaanse mayor wordt een Nederlandse burgomaster niet gekozen; hij wordt geacht boven de partijen te staan, en heeft minder bevoegdheden of uitvoerende macht.

Vertaaltip:
De voorkeursvertaling van het Nederlandse woord ‘burgemeester’ is burgomaster.

 

10. opinion / decision / ruling / judg(e)ment (zie noot 47:…. ‘uitvaardigen’ / ‘uitspreken’)

(AmE) (judicial) opinion* = (BrE) judgment / (BrE also frequently:) opinion

Hoewel de termen “opinion”, “ruling”, “judg(e)ment”, en “decision in de dagelijkse praktijk in het AmE en BrE probleemloos door elkaar heen worden gebruikt in de ruime betekenis van “rechtrlijk uitspraak” (inclusief motivatie), zijn er volgens Garner’s Dictionary of Legal Usage strikt genomen toch een aantal verschillen tussen het Britse en Amerikaanse gebruik van de termen.
Garner noemt de volgende verschillen:
(AmE) opinion = “The court’s statement explaining its decision The BrE equivalent is judgment, but the word opinion is also frequently used. In BrE, opinion more commonly refers to advice given by counsel on facts set out in a case, or in a memorandum submitted to counsel.
“In BrE, judgment is commonly used in the sense in which judicial opinion is used in AmE. (…) Continental legal systems likewise use
judgment in this way.”
“Tecnically, in the U.S., judges are said to write opinions to justify their decisions or judgments; they do not write decisions or judgments.”
“The word “ruling” is not synonymous with “opinion“.
Judgment is the preferred form in AmE and seems to be preferred in British legal texts, even as far back as the 19th century. Judgement is prevalent in British nonlegal texts (…) Not in AmE.”

Voorbeelden waarbij in het AmE ‘opinion’, ‘judgment’, ‘decision’, ‘ruling’ als synoniemen worden gebruikt, in de betekenis van “rechterlijke uitspraak, met inbegrip van de motivatie” :
De Amerikaanse jurist-auteur Scott Turow gebruikt in de roman Reversible Errors (2002) alle vier termen (AmE) opinion / ruling / decision / judgment door elkaar, in  hoofdstuk 31 “The Court Rules”.
Turow gebruikt de term “opinion” (of “written opinion”) het eerst, en vaakst (6 x), en de andere synoniemen vervolgens als stilistische variatie (de term ‘decision’ komt 3 x voor, en ‘judgment’ en ‘ruling’ elk 1 x):

“The Court of Appeals had issued its opinion: Gandolph’s habeas had been dismissed and the stay on his execution lifted.”
“The Chief Clerk of the Court of Appeals called (…) to notify (…) that they would release the decision (…) in an hour.”
“She (…) praised the judgment of the U.S. Court of Appeals”
“Gillian did not hear of the ruling until midafternoon.”
In de roman Limitations (2004) gebruikt Scott Turow de termen “opinion” and “decision’ als synoniemen:
“For a century and a half, legal education has been focused on reading the opinions of judges like George who sit on courts of review. In his days professors discussed these decisions. “ (chapter 11)

Voorbeelden in het BrE waarbij ‘opinion’, ‘judgment’, ‘decision’, ‘ruling’ als synoniemen worden gebruikt, in de betekenis van rechterlijke uitspraak, met inbegrip van de motivatie:
In het artikel  “Influential Rulings and Modern Attitudes in Court Win Plaudits” (in de bijlage over “Innovative Lawyers “van de Financial Times van 6 juli 2007) kwamen de volgende zinnen voor:

easement : erfdienstbaarheid gezien vanuit het standpunt van degene die het recht heeft, de heersende partij
servitude: erfdienstbaarheid, gezien vanuit het standpunt van degene die het recht verleent (bijv. het land/goed waarop de erfdienstbaarheid gevestigd is), de dienende partij
easement is een begrip uit het gewoonterecht (de Angelsaksische common law)
servitude is een civil law term
Easements waren historisch beperkt tot het recht van overpad (right of way) en het gebruik van waterbronnen op het land van iemand anders, maar de definitie is later uitgebreid naar andere vormen van erfdienstbaarheid.
Easements zijn landgebonden, niet persoonsgebonden, ze gaan dus bij een landoverdracht over naar de nieuwe eigenaar.

14. (AmE) medical examiner / (BrE/AmE) coroner (deze term wordt soms onvertaald gelaten omdat de functie niet helemaal vergelijkbaar is met een bestaande Nederlandse functie (lijkschouwer, onderzoeksrechter).

(BrE) coroner = onderzoeksrechter, rechter van instructie; een onafhankelijk, benoemd lid van de rechterlijke macht (uiteindelijk onder de verantwoordelijkheid van het Ministerie van Justitie); vaak met een academische rechtenopleiding en/of een medische graad; hij/zij is verantwoordelijk voor het onderzoeken van de (medische) oorzaak bij een plotselinge en/of gewelddadige/verdachte dood (“in a coroner’s court”). Ook: “Her Majesty’s Coroner”. Zie link.

(AmE) coroner = in een aantal counties (bijv. plattelandsgebieden met weinig geweldsmisdrijven en weinig middelen om een professionele medical examiner aan te kunnen stellen) is de coroner een gekozen ambtenaar, soms verenigd met het ambt van (county) sheriff, maar het kan ook een middenstander, landbouwer, etc. zijn, zonder enige medische of juridische opleiding; de coroner is verantwoordelijk voor het vaststellen van het tijdstip, de oorzaak, en de omstandigheden van een plotselinge/verdachte/gewelddadige dood; de inhoud van de functie verschilt per staat; het komt er meestal op neer dat de coroner vaststelt dat de dood is ingetreden, dat het stoffelijk overschot wordt geïdentificeerd, dat naaste familie wordt ingelicht, persoonlijke bezittingen van de overledene aan de nabestaanden worden overhandigd, en dat de overlijdensakte wordt getekend; als er lijkschouwing nodig is wordt er doorgaans een beroep gedaan op een professionele (door de staat aangestelde) medical examiner; zie link.
In veel Amerikaanse jurisdicties (bijv. steden zoals New York) is de functie van coroner nu meer geprofessionaliseerd en vervangen door die van de, meestal benoemde, (AmE) medical examiner (= M.E.) , die wèl een medische opleiding moet hebben (forensic pathologist), en soms óók een juridische opleiding;
Wanneer de functie van (AmE) coroner is samengevoegd met die van sheriff, kunnen de juridische verantwoordelijkheden van de functie gescheiden zijn van de medische aspecten, die dan aan forensische experts worden gedelegeerd (een medical examiner, technician, forensic pathologist), bijv. in Monterey Country, California.

In het dagelijks spraakgebruik, worden de AmE termen coroner / medical examiner (‘lijkschouwer’) als synoniemen beschouwd, en is het gebruik afhankelijk van welk ‘systeem’ verschillende staten hanteren. Dit blijkt bijvoorbeeld uit het volgende citaat:
“[Mr.] Bergin was officially pronounced dead by what Sean assumed was a coroner or a medical examiner – he couldn’t recall what system Maine used.” > Bergin werd officieel doodverklaard door een lijkschouwer of patholoog-anatoom, dacht Sean – hij wist niet welk systeem ze in Maine hadden. Over de bijzondere achtergronden van het gekozen ambt van (AmE) coroner in de staat Mississippi, schrijft John Grisham in de roman
Sycamore Row (2013), waarvan het verhaal zich in 1988 afspeelt, het volgende:

“Finn Plunkett was a rural mail carrier when he was first elected county coroner thirteen years earlier. At the time, he had no experience in medicine; none was required in Mississippi. He had never visited a crime scheme. The fact that the state still elected its county coroners was odd enough; it was one of the last states to do so. Indeed, it was one of the few to ever initiate the ritual to begin with. (…) His typical routine was to hover over a corpse and solemnly pronounce, ‘Yep, he’s dead.’ Then he would speculate on the cause of death and sign a certificate.” (Sycamore Row, chapter 41)

Vertaaltips en dilemma’s:
Omdat er in het Nederlands taalgebied geen onderscheid bestaat tussen de gekozen lijkschouwer enerzijds (AmE coroner), en de benoemde/aangestelde lijkschouwer die een volwaardige beroepsopleiding heeft genoten anderszijds (AmE: medical examiner), is het voor vertalers onmogelijk om dit landgebonden, “culturele” verschil bondig tot uitdrukking te brengen.
Voorbeeld:

(BrE) solicitor =  a general legal advisor, d.w.z. een algemeen praktiserend advocaat / juridisch adviseur, die clienten mag bijstaan voor de lagere rechtbanken (in civielrechtelijke zaken mag hij/zij de client in de rechtbank bijstaan; strafrechtzaken mag hij/zij alleen voorbereiden, een brief (= zaakdossier) schrijven en deze vervolgens aan een barrister overdragen die de client dan in de rechtzaal bijstaat; de solicitor is ook bevoegd documenten zoals contracten en testamenten op te stellen (vgl. Nederlandse notaris, zie note 1).
Het takenpakket van de solicitor:
(1) conveyancing (overdracht onroerend goed, eigendomsoverdracht)
(2) probate (testamenten, wilsbeschikkingen)
(3) drafting (company and commercial) contracts
(4) preparation of litigation (voorbereidend werk voor rechtzaken); ook wel “instructing solicitor” genoemd.
Sommige Britse solicitors hebben een bord aan de weg staan waarop ze hun diensten aanbieden, zoals : civil and commercial litigation, residential & commercial conveyancing, contract disputes, licensing, wills & probates, immigration & nationality
(BrE) solicitors kunnen ook in overheidsdienst zijn , en bijvoorbeeld als lid van het Openbaar Ministerie een functie bekleden die deels overeenkomst met (Ned.) “officier van justitie”/  “openbaar aanklager”.

Vertaaltips en dilemma’s:
In de roman A Question of Guilt van Frances Fyfield is het hoofdpersonage Helen West als “solicitor” in dienst bij de Crown Prosecution Service. Haar functie kan in dat geval heel goed met “officier van justitie” of “openbaar aanklager” worden vertaald, ook al blijft er een onderscheid tussen deze Nederlandse functie en de Britse functie van “solicitor” waarbij de persoon in kwestie niet actief als in de rechtszaal optreedt.
The Chambers clerk treated Helen and all solicitors who provided work, and thus his commission, with sedulous courtesy. (…) His Cheshire-cat grin, a sign of approval of Helen West. A good instructing solicitor, (…) she was a lynchpin of the case (…) > De kantoorbediende van het advocatenkantoor liet geen gelegenheid voorbijgaan om Helen en andere officieren van justitie die voor werk, en dus voor zijn salaris, zorgden hoffelijk te bejegenen. (…) Op zijn gezicht verscheen een brede grijns, een teken dat hij Helen West wel mocht. Een goede officier van justitie, (…) ze was de spil van de zaak (…). In de Britse advocatenhierarchie speelt de “solicitor” een voorname rol, zoals blijkt uit een opmerking van barrister Charlotte Proudman in het BBC-programma Newsnight (15 spet. 2015): “We all know about the power dynamics between barristers and solicitors. I’m a barrister and I rely on work from solicitors in order to progress my professional career.”
Net als de Nederlandse notaris (zie note 1) is de (BrE) solicitor vaak een vaste vertrouwenspersoon die voor alle juridische adviezen en handelingen kan worden ingeschakeld (zie ook de voorbeelden bij ‘coroner’):

In het Amerikaanse standaard-etiquetteboek van Emily Post is zelfs een waarschuwing opgenomen tegen “solicitors”:
– Outside solicitors – salespeople, people seeking employment, religious groups, charitable and political canvssers, and census takers – generally have legitimate motives, but it’s wise to be cautious. Even if you’ve checked a solicitor’s credentials and are certain that he or she is legitimate, don’t offer referrals or give out any information about your neighbours. (Emily Post’s Etiquette, 17th edition, 2004, pp. 124-5)
– Directing your anger at telephone solicitors is about as constructive as throwing your phone across the room. It’s the organization that hires the solicitor that is to blame, not the individual who’s trying to make a living. Common sense says that taking your frustration out on the solicitor is not going to keep such calls at bay. (…) If a solicitor won’t take no for an answer, be firm: “I’m sorry, but I’m not interested, and I must hang up now.” Then do so. Just don’t slam down the phone. The federal courts were in place to deal with such far-flung disputes, and Miyer-Brack and its phalanx of lawyers tried gallantly to remove the case. Judge Atlee held firm, as did the federal judge. Vertaaltips en dilemma’s:
Vanwege de verschillende functies en werkwijzen van de Nederlandse gerechtsinstanties , wordt een vertaling naar het Engels (bijvoorbeeld: higher/lower/inferior court, superior court, senior court, court of higher/lower jurisdiction, court of first instance), vaak gevolgd door de Nederlandse term tussen haakjes (Hoge Raad, gerechtshof, arrondissementsrechtbank). Omgekeerd (in vertalingen vanuit het Engels), geldt dat ook.

Wanneer een vertaling voor een lekenpubliek bedoeld is, zoals bijvoorbeeld in een roman, wordt (AmE) Chancery Court wel eens met ‘arrondissementsrechtbank’ vertaald, maar dat kan vervolgens weer tot verwarring leiden wanneer de taken en bevoegdheden van die Amerikaanse rechtbank worden toegelicht. Ze zijn duidelijk anders dan die van de Nederlandse arrondissementsrechtbank.

(AmE) judge = rechter van een lagere rechtbank (trial court) of een hof van beroep (appellate court): maar er zijn een aantal staten, zoals New York en Texas, waar deze rechters de titel van justice hebben (zie Garner’s Dictionary of Legal Usage voor meer informatie m.b.t. uitzonderingen).

Van de negen leden van het Amerikaanse Supreme Court, zowel op federaal niveau als op het niveau van de staten, heeft de voorzitter van dit rechtscollege  de titel van Chief Justice en hebben er acht de titel van Associate Justice. Alle negen leden zijn volwaardige rechters van het Hooggerechtshof, en een Associate Justice is dus niet een ‘adjunct-rechter’ of iets dergelijks.Hetzelfde geldt voor de titels Chancellor / Vice Chancellor met betrekking tot de rechters van de zogeheten Courts of Chancery die in een aantal Amerikaanse staten, zoals New Jersey of Delaware, voorkomen. De Court of Chancery in de staat Delaware is bijvoorbeeld  een vijf-koppig rechtscollege bestaande uit een Chancelor en vier Vice-Chancellors.Zie de problematische vertaling door Ko Kooman  van The Plot Against America, chapter 7):

Chancery Court = an equity court, ofwel een rechtbank voor o.a. (1) faillissementszaken zoals in de staat Delaware (chancery court = bankruptcy court), of (2) voor zaken waarbij minderjarigen zijn betrokken en/of die betrekking hebben op conflicten over nalatenschappen, zoals in Mississippi (chancery court = equity court). Courts of equity (Courts of Chancery) behandelen geen claims over schade aan persoon of goed. Een ‘court of equity’ is in die zin niet gelijk aan een ‘court of law’. Equity & law zijn dus verschillende begrippen. Equity courts baseren zich niet primair op de precieze toepassing van wetsartikelen:

Solicitor is the BrE term for a lawyer who gives legal advice and prepares documents, for example when you are buying a house, and sometimes has the right to speak in a court of law.

22. courante Amerikaanse termen – verouderde Britse termen
Een opvallend verschil tussen een aantal Amerikaanse en Britse (EngE, etc.) juridische termen is dat woorden die in het BrE inmiddels verouderd zijn of in onbruik raken (obsolete, obscolescent), in het Amerikaans gewoon tot het standaardvocabulaire blijven behoren. Een voorbeeld is de toevoeging Esq. (afkorting van Esquire) achter de naam van een (mannelijke of vrouwelijke!) advocaat in de VS (an attorney/lawyer who has been admitted to the bar). Een ander voorbeeld is het gebruik van de termenfelony (misdrijf) en misdemeanour (overtreding) in het Amerikaanse strafrecht: het is een gebruik dat in het Engelse strafrecht niet meer bestaat (zie note 5).

BrE: in Britse rechtzaken leidt dit tot een gedeeltelijke/proportionele veroordeling en straf (= AmE comparative negligence).
AmE: in Amerikaanse rechtzaken leidt dit tot vernietiging van de zaak, en een totale afwijzing van de claim.

Een bedrijf dat surseance van betaling heeft kan niet tegelijkertijd failliet worden verklaard (het kan wel in een faillisssement overgaan).
De juridische bescherming van bedrijven die in financiële problemen zijn geraakt (faillissement, curatele, surseance) is niet in alle Engelstalige landen gelijk. In de V.S. is e.e.a. geregeld in de Federal Bankruptcy Code, waarvan (AmE) Chapter 7 (rechtstreeks faillissement), (AmE) Chapter 11 (surseance van betaling), en Chapter 13(schuldsaneringsplan over een periode van 3-5 jaar) de belangrijkste zijn. Om voor deze bescherming in aanmerking te komen (tegen de aanspraken van de schuldeisers) moet er een uitspraak worden gevraagd van een (AmE) bankruptcy court.

(AmE) class action = (AmE) representative action (een soort ‘mass tort action’) : rechtszaak volgens het ‘opt-out’ principe, d.w.z. de uitspraak geldt voor iedereen tenzij men zich uitdrukkelijk heeft afgemeld, bijv. in een zaak tegen een sigarettenfabrikant.

30. Juridische termen (BrE, AmE, CanE, AusE, NzlE, ScotE, NirE, IrE)
Vanwege de verschillen in rechtssytemen, niet alleen tussen de VS en Groot Brittannië, maar ook tussen de Amerikaanse staten onderling, en tussen de juridisch autonome gebiedsdelen van het Verenigd Koninkrijk (vooral Engeland en Schotland), is het zo nu en dan belangrijk die verschillen expliciet aan te geven. In het Verenigd Koninkrijk kan een juridisch woord of begrip dus bijvoorbeeld specifiek Engels (EngE, hieronder valt ook het rechtssysteem van Wales), Schots (ScotE), of Noord-Iers (NirE) zijn. Wat betreft de VS is een voetnoot kan er een toelichting nodig zijn, eventueel als voetnoot. Ook zijn er specifieke Canadese (CanE), Australische (AusE), Nieuw-Zeelandse, of Ierse (IrE) verschillen.
Typisch Britse termen: barrister, solicitor, etc.
Typisch Amerikaanse termen: lawmakers (= Members of Congress), plea bargaining (het schikken van een rechtzaak vóórdat de rechter de zaak inhoudelijk onderzoekt), forum shopping (= het kiezen van de rechtsinstantie (federal/state) die men het gunstigst acht voor de rechtzaak), punitive damages (= exemplary damages, hele hoge schadevergoeding als straf), grand jury, etc.

31. vs. / v.
Volgens Garner’s Dictionary of Legal Usage (3e ed., 2011): zijn zowel “vs” als “v” gangbare afkortingen van “versus’ in het AmE, maar is “vs” gebruikelijker in een niet-juridische context.
(BrE) versus = v               Uitspraak in juridisch verband*: [and]
(AmE) versus = v. / vs.   Uitspraak: [versus] of [against]
*Voorbeelden:
(1) In een aflevering van het BBC programma QI vertelde presentator Stepehn Fry: “There was a case called Jennens v [= vie] Jennens, or as a lawyer would say Jennens and Jennens”. (Het betrof de in 1795 begonnen rechtzaak die Charles Dickens inspireerde tot het schrijven van de roman Bleak House en omdoopte tot Jarndyce v Jarndyce”.
(2) In de verfilmde versie van A Certain Justice van P.D. James wordt “v” overigens uitgesproken als [versus]. Dit betreft de episode uit hoofdstuk 32 waarin Mrs. Janet Carpenter dood wordt aangetroffen met de letters “R v Beale” (in de film-versie “R v B”) op haar arm geschreven, uitgesproken als [Regina versus Beale].

In niet-juridische contexten wordt (BrE) v uitgesproken als [vie] of [versus] . Bijvoorbeeld in sportwedstrijden zoals de 6-Nations rugby tournament: “Wales v Italy” = “Wales [vie] Italy”.
In het sportprogarmma Match of the Day (BBC) lijkt de uitspraak [vie] de overhand te hebben, maar [versus] komt ook voor, bijvoorbeeld door presentator/ex-voetballer Gary Lineker tijdens de World Cup 2014: “England v Uruguay” [= versus].

Doe v. Bolton / Roe v. Wade
In Amerikaanse rechtzaken die namens een anonieme cliënt gevoerd worden, wordt zowel het pseudoniem John/Jane Doe, als John/Jane
Roe
wel gebruikt. Voorbeeld: een belangrijke federale zaak waarbij het recht op abortus werd toegestaan wordt vaak Roe v. Wade genoemd. Een andere abortuszaak heet Doe v. Bolton.

32. gevangenis / (AmE) jail / (AmE) prison + slang-words
(BrE) gaol/jail geldt  als synoniem van (BrE) prison. De voorkeurspelling is ‘jail’. De spelling  ‘gaol’ beperkt zich voornamelijk tot juridische geschriften en wetboeken.

(AmE) jail: bijvoorbeeld ‘city jail’, ‘regional jail’, county jail’ (doorgaans voor gevangenen die nog niet veroordeeld zijn, maar ook voor veroordeelden van minder ernstige misdaden); ook: huis van bewaring (jail  = a ‘presentence facility’
(AmE) prison: bijvoorbeeld ‘state prison’ (meestal voor zwaardere vergrijpen) = state penitentiary

De Amerikaanse termen jail, prison en lockup zijn geen synoniemen.
(AmE) jail betreft een detentie-inrichting voor (1) gearresteerden die in afwachting zijn van hun berechting (a presentence facility), en (2) voor hen die wegens een minder ernstig feit (misdemeanor) zijn veroordeeld, c.q. kortgestraften (meestal tot maximaal 2 jaar cel). Afhankelijk van de context moet (AmE) ‘jail’ dus vertaald worden als
(1) ‘huis van bewaring’
(2) ‘gevangenis’ (voor kortgestraften) (AmE) prison  (ook: penitentiary / pen) is een ‘gevangenis’ voor hen die tot een langere gevangenisstraf (meestal vanaf 2 jaar) zijn veroordeeld wegens een zwaarder vergrijp ( ‘felony’).

(AmE) lockup = arrestantencel, politiecel. Het betreft een cel (holding cell) die kan worden gebruikt omdat er tijdelijk geen mogelijkheid is om een arrestant naar een ‘jail’ over te brengen.

Voorbeelden (AmE) jail x prison:

In Nederland wordt het als echt waarmerken van een document evneeens door een notaris gedaan.
Behalve als het een uittreksel van de burgelijk stand betreft (die kan op het gementehuis worden afgehaald. Idem m.b.t. uittreksels van de Kamer van Koophandel, het Kadaster, etc. Deze instanties beschikken over “recordable copies”waarvoor geen “notarization” nodig is. Gewaarmerkte kopieën van schooldiploma’s mogen door DUO (Dienst uitvoering Onderwijs te groninegn) worden afgegeven.

In de VS is “authentication” van toepassing op documenten die door een “notary public” zijn gewaarmerkt en die voor buitenlands gebruik zijn bedoeld. In de VS is de functie van “notary public” een lichte functie waarvoor geen rechtenopleiding is vereist en die voor een beperkte termijn wordt vervuld, waarna het opnieuw door de Secretary of State kan worden verlengd (mits er geen onregelmatigheden zijn gemeld  bij de Secretary of State).

Het Amerikaanse verplichting om een “authorization” van “notarized document” te verkrijgen is daarom een waarborg die minder van toepassing op een document dat door een Nederlandse notaris (die aan strengere eisen moet voldoen) is gewaarmerkt.

Ïn de meeste Amerikaanse staten vervult de Secretary of State (ook wel: State Secretary genoemd) de functie van Minister van Binnenlandse Zaken. Enkele andere staten hebben een Lieutenant Goverbnor of een Secrtary of the Commonwealth. Hij/zij is verantwoordelijk voor, onder andere, de aanstelling van notaries public, burgerzaken, de organisatie van verkiezingen, etc.  (Zie voetnoot.)

In Nederland wordt een “authorization” voor een beëdigde vertaler, kan deze worden verkregen in de vorm van een legalisatie- of apostillestempel bij de arrondissementsrechtbank waar de beëdigd vertaler geregistreerd staat.

Voor overige doeleinden kan een “authorization” (in de vorm van een apostille of legalisatie) in Nederland ook worden afgegeven door het Ministerie van Buitenalndse Zaken.

In het Verenigd Koninkrijk heeft “transcript” een andere betekenis (= “transcriptie”), is de term “study file” min of meer synoniem.

Het Nederlandse “leerdossier” (study file) is enigszins vergelijkbaar. Een student met Nederlandse diploma’s kan volstaan met het overleggen van gewaarmerkte kopieën van de diploma’s met bijbehorende cijferlijsten plus de door de onderwijsinstelling afgegeven syllabus (ook wel “studiegids” of “studiewijzer”), d.w.z. een officiële beschrijving van de gevolgde vakken per leerjaar met het bijbehorende aantal studiepunten (studielast).

In de VS zijn de meeste bevoegdheden gedelegeerd naar het niveau van de afzonderlijke staten, waar de functie van ‘minister van Binnenlandse Zaken’ wordt bekleed door de Secretary of State (in sommige staten: Lieutenant Governor, zie note 3 hieronder). Garner’s Dictionary of Legal Usage (3rd edition) definieert de Engelse betekenis van (BrE) marshal als volgt:

Horwill gaf de volgende toelichting bij (AmE) marshal:
“The duties of an American marshal are much more arduous. ‘For the execution of its powers each federal court has attached to it an officer called the U.S. marshal, corresponding to the sheriff in the State governments, whose duty it is to carry out its writs, judgments, and orders by arresting prisoners, levying execution, putting persons in possession, and so forth. Garner’s Dictionary of Legal Usage (3rd edition) onderscheidt de volgende (AmE) betekenissen van marshal:
(1) a law enforcement officer with duties similar to those of a sherriff
(2) a judicial officer who provides court security, executes process, and performs other tasks for a court

De taken van een U.S.marshal :
(1) doet ook dienst als (federale) “deurwaarder” = (AmE) process server, (BrE) bailiff.
(2) fungeert verder als federaal politieagent die toezicht houdt op voorwaardelijk vrijgelaten gevangene, en die personen arresteert en voorgeleidt waartegen door een federale rechtbank een arrestatiebevel is uitgebracht.
(3) en/of fungeert als gerechtsfunctionaris, parketwachter (in a federal court)

Tijdens een commissiezitting in de Amerikaanse Senaat (10 januari 2022), somde Senator Tom Cotton de functie en taken van de U.S. marshal als volgt op: a law enforcement officer whose duities comprise:
(1) to guard federal courthouses and judges

(3) to protect witnesses in the witness protection program

“The rather undignified term ‘clerk’ is used in reference to an American law student who works for a law firm before receiving a law degree and passing the bar exam. In response to the meniality connoted by this term, some lawyers have borrowed ‘extern‘ from the medical profession, but its use is not widespread. For ‘clerks’ who work with a firm during the summer months, lawyers have hit upon ‘summer associate‘ or ‘summer clerk‘, which has gained currency throughout the U.S. among firms that recruit heavily.
Unlike law firms’ law clerks, judge’s law clerks have usually already passed the bar exam and accepted a permanent position for the following year. Hence, because they are already lawyers, the apparent meniality of ‘law clerk’ is especially ironic. Some courts therefore call their clerks briefing attorneys, but to one unaccustomed to the unpretentiousness of ‘law clerk’, this term seems inflated. (BrE) senior clerk, junior clerk (op een barristers’ offices / set of Chambers) = hoofd van het ondersteunend niet-juridisch personeel op een advocatenkantoor; een soort bureauchef; behorend tot de administratieve “staff”, in tegenstelling tot de “members” van het advocatenkantoor. Let op het verschil met de tijdelijk aangestelde (AmE) legal clerk (= advocatenstagiair, advocaat in opleiding, advocaten assistent =  BrE: pupil), of de vaste positie van de (AmE)(judge’s) law clerk = (AmE) judicial clerk, die juridische taken vervullen ter ondersteuning van respectievelijk een advocaat en rechter. De Nederlandse titel “mr.” (meester in de rechten) kan inhoudelijk gelijk worden gesteld aan (BrE) LL.B. en (AmE) J.D. Voor meer praktische informatie over de wenselijkheid of onwenselijkheid van het vertalen van de Nederlandse meesterstitel met “Master of Laws”of LL.M, zie de Nuffic-website.

Sinds 1986 mag een Nederlandse meester in de rechten (“mr”) desgewenst/gemakshalve de titel Master of Laws of LLM achter zijn/haar naam voeren (zie ook de Nuffic-website, link). De belangrijkste reden om de meestertitel niet onvertaald te laten is dat het verwarring met het Engelse voorvoegsel Mr. voorkomt. “Master of Laws” is geen beschermde titel, en geeft alleen een indicatie van het feit dat er een academische graad in de rechten is behaald. De betekenis van de titel Master of Laws (LL.M)varieert sterk van land tot land. De titel wordt formeel vooral gebruikt in de internationale context van de Engelstalige éénjarige rechtenopleiding die in meerdere landen wordt aangeboden. Toelichting:

If you are being held on remand you will be set as a Cat B prisoner. After some time in prison you may be set as a lower profile prisoner and  will be categorised as Category C who are defined as “Those who cannot be trusted in open conditions but who are unlikely to try to escape”. Finally there are Category D prisoners who are held in open prisons which have a more relaxed regime.
